Agreement
These Terms of Service ("Terms") govern access to and use of the AI Fortis Voice AI Platform at app.aifortis.com (the "Service"), operated by AI Fortis Ltd. („ЕЙ АЙ Фортис“ ООД), EIK 208238799, VAT BG208238799, 1 Gen. Stefan Toshev St, 1618 Sofia, Bulgaria ("AI Fortis"). The Service is provided to businesses only (B2B). By creating an account or using the Service you accept these Terms on behalf of the business you represent and confirm you are authorised to do so.
The Service
AI Fortis provides a platform through which AI voice agents make and receive phone and web calls on behalf of clients, including agent configuration, telephony connectivity, campaign management, call recordings, transcripts and analytics. The Service is built on third-party voice, AI and telephony infrastructure (see the Sub-processors page).
Accounts
- You must provide accurate information and keep your credentials and API keys secure. You are responsible for all activity under your account.
- Accounts are for business use by the client's authorised users; you are responsible for your users' compliance with these Terms.
- We may require multi-factor authentication for certain roles.
Acceptable use and compliance
- No illegal robocalls. You may place calls only where you have a lawful basis to contact the recipient under the applicable telemarketing, e-privacy and consumer-protection laws of the jurisdictions you call.
- You are the data controller of your end-customer data. Recording-consent, AI-disclosure and notice obligations toward call recipients rest with you; you must include the required disclosures in your agents' greetings and scripts and ensure they are correct for the jurisdictions you call.
- You must honour do-not-call (DNC) obligations, maintain your DNC / opt-out lists in the platform, and promptly suppress numbers that opt out.
- The Acceptable Use Policy forms part of these Terms.
- We may suspend campaigns or accounts we reasonably believe violate law or these Terms.
Fees and billing
- Fees consist of usage-based charges (per-minute and/or per-call rates) and recurring monthly fees, in each case as agreed in your order, plan or written agreement with AI Fortis.
- Usage is metered by the platform and billed in arrears unless otherwise agreed. Third-party pass-through costs (e.g. carrier charges) may apply as set out in your order.
- Invoices are payable within the term stated on the invoice. We may suspend the Service for non-payment after notice.
- Prices are exclusive of VAT and other applicable taxes.
Availability
We aim for high availability, but the Service depends on third-party AI, voice and telephony providers and is provided "as is" and "as available", without warranty of uninterrupted or error-free operation. Service levels apply only if agreed in a separate SLA.
Intellectual property
- AI Fortis and its licensors own the platform, its software and all related intellectual property. You receive a limited, non-exclusive, non-transferable right to use the Service during the term.
- You retain all rights to your data (contact lists, call content, configurations). You grant us the rights needed to operate the Service on your behalf.
- Feedback may be used to improve the Service without obligation to you.
Liability
To the maximum extent permitted by law: (a) neither party is liable for indirect, incidental or consequential damages, or for loss of profits, revenue or data; and (b) AI Fortis' total aggregate liability under these Terms is capped at the fees paid by you for the Service in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law (e.g. for wilful misconduct).
Indemnity
You will indemnify AI Fortis against third-party claims arising from your call content, your contact data, or your breach of telemarketing, consent or data-protection obligations.
Data protection
The Data Processing Agreement (DPA) applies to personal data we process on your behalf and forms part of these Terms. See also the Privacy Policy.
Suspension and termination
Either party may terminate as set out in the applicable order. We may suspend or terminate for material breach, unlawful use or non-payment. On termination, data is exported, returned or deleted in accordance with the DPA.
Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Bulgaria. Disputes are subject to the exclusive jurisdiction of the competent Bulgarian courts.
